This provision should be read in conjunction with the HKETC General Terms & Conditions.
1． INTRODUCTION
This Domain Name Registration Agreement (this Agreement) constitutes the Registrant's acceptance to HKETC Domain Name Registration Services and Related Terms & Conditions. To completion of the registration process, the Registrant must be admitted that they have read, understood and agree to this Agreement, the appropriate fees, the dispute policy, other supplemented terms & policies and any released and effective regulations or policy constraints by HKETC. This agreement will be effective as registrant submits application for registration of any type of Domain Names, including but not limited to, Global Domain Names (ie. .com, .org, .net), country Domain Extensions (.hk, .cn, .fr),Multilingual Domain Names (.中国, .香港), to HKETC's website - HKETC.
When Registrant apply registration of respective Domain Name from this site, the registrant must complete an application form. After our staff received and inspected your application, we , on your behalf, will submit your domain registration to respective Domain Name Registries as follows :-
Global Domain Names The Internet Corporation for Assigned Names and Numbers (ICANN)
China Domain Names China Internet Network Information Center (CNNIC)
Hong Kong Domain Names Hong Kong Domain Name Registration Company Limited (HKDNR)
Taiwan Domain Names Taiwan Network Information Center (TWNIC)
Other Domain Names Respective Domain Name Registries
2． SELECTION OF DOMAIN NAME
HKETC is not responsible for the review of the Registrant's selection of Domain Name nor whether the use of Domain Name infringe the legitimate interests of others. HKETC urge the Registrant to verify whether the selection and use of its Domain Name infringe the legitimate interests of others, HKETC highly recommended the Registrant consult with a qualified adviser. The Registrant may consider to enquire the Domain Name & relating matters with one or more trademark registration agencies. The application of the Domain Name may be cancelled, changed or transferred by the judgement of the court. If HKETC be litigated or by the threat of litigation due to Registrant's Domain Name, HKETC will be in accordance with the following damages clauses propose claim, to make HKETC free from damage and obtain compensation from the Registrant.
3． PAYMENT & REFUND
3.1 As to apply the Domain Name Registration services and other services provided by HKETC, the Registrant must register as a member, the company does not charge membership registration fee nor membership annual fee. Members (as Registrants) are required to prepay for services and may decide the amount of prepayments. With the consent of the member, according to the fees published on the website, when member apply for Domain Name registration and other services, the system will deduct from the member's account respectively. HKETC will not refund (in full or partial of) the paid service charges, even if the Domain Name is suspended, canceled or transferred or is caused by other related services which unable to provide, before the expiry of the deadline for registration. The Registrant must settle the Renewal Fees with HKETC before the expiration of the Domain Name or other related service(s). Else as a result caused by No renewals for Domain Register and/or related service(s) : delete, transfer or registration by others, HKETC does not assume any liability, all losses solely responsible by the Registrant.
3.2 Refund of Account Balance (if any) can be applied in written notice to the company. Admin Charge : HKD50 will be deducted from Registrant's account. Net Balance (Account Balance - Admin Charge HKD50), will be paid by cheque to Registrant in 4 to 6 weeks.
3.3 Domain Name Registration Failure as "Unable to Apply" or "Refuse of Application" (including International Domain Name(IDN), Hong Kong Domain Name (HKDN) or China Domain Name (CDN)) caused by our Company mistake. The application fee already paid will be refunded in full by cheque to Registrant in 4 to 6 weeks. Apart from this, HKETC does not assume any liability or compensation.
3.4 Domain Name Registration Failure as "Unable to Apply" or "Refuse of Application" (including International Domain Name (IDN), Hong Kong Domain Name (HKDN) or China Domain Name (CDN)) caused by Registrant due to, but not limited to, data errors, inaccurate, outdated, incomplete on application forms or could not provide the required documents and information within a specified period . The application fee already paid will not be refunded. HKETC does not assume any liability or compensation.
4． CREDIT CARD REJECTED PAYMENT AND FRAUD
If the Registrant's credit card company reject payment, credit card fraud or any other payment issues, the Registrant will lose all the rights for the Domain Name registration . HKETC will make an independent judgment to decide to hold or own the Domain Name or transfer to others.
5． DISPUTE POLICY [Domain Name Dispute Resolution Policy]
The Registrant agrees to accept the respective Domain Name Registries' "Domain Name Dispute Resolution Policy" (hereinafter referred to as the "Dispute Policy") constraint, the Dispute Policy is a part of this agreement. When third party make objection to the Registrant's Domain Name Registration, the effective Dispute Policy Terms & Conditions bind any possible dispute involving the right of use of Registrant's Domain Name. The Registrant also agree if Domain Name dispute with a third party occurs, the Registrant will in accordance with Dispute Policy Terms & Conditions compensate HKETC and make HKETC free from damage. HKETC may at any time in accordance with respective Domain Name Registries' Dispute Policy make a revision.
To continue using HKETC Registration Service, Registrant must accept to respective Domain Name Registries' Dispute Policy and the revision(s).
6． THE USE OF REGISTRANT’S INFORMATION/B>
As part of the registration process, the Registrant shall provide specific information and promptly update this information to ensure the information are up to date, complete and accurate.
This information including, but not limited to :
6.1 The Registrant English or Chinese name, mailing address, e-mail address, contact telephone number and fax number.
6.2 The authorized contact person name, in English or Chinese, of a legal entity, including, but not limited to a company, organization or association.
6.3 Domain Name Servers (DNS).
6.4 Corresponding name of Domain Name Server.
6.5 Technical Support for Domain Name Management : Contact Name (in full), mailing address, e-mail address, contact telephone number and fax number.
6.6 Administrator for Domain Name Management : Contact Name (in full), mailing address, e-mail address, contact telephone number and fax number.
6.7 Regional Contact for Domain Name Management : Contact Name (in full), mailing address, e-mail address, contact telephone number and fax number.
6.8 Any relevant records shown in WHOIS information which related to the Domain Name.
Registrant who renew Domain Name registration, the requested type of information may change. The Registrant not agree to provide new & essential information, the Domain Name registration may not be renewed. The Registrant willfully providing inaccurate information or intentionally fails to update the information would constitute a major breach of this Agreement and may lead to deletion of the Registrant's Domain Name. The Registrant authorize third party to use the Domain Name, the Registrant is still the holder of the Domain Name and shall be responsible for providing all of the contact information including up to date, accurate Technical, Administrator, and Regional contact information. When HKETC. verify Registrant detail contact information, if the Registrant fails to reply within fifteen (15) days, this constitutes a major breach of this Agreement and lead to deletion of the Domain Name. According to respective Registries' request, HKETC. will publish certain information provided by the Registrant during the registration process.
7． USE OF SERVICE POLICY
If the Registrant is using the Domain Name deliberately sent in violation of applicable laws or advertising generally acceptable Internet use policy, or using Domain Name for illegal acts; HKETC reserves the rights to the suspension or deletion of the Domain Name.
8． AGENT AND PERMISSION
If the Domain Name is registered by the Registrant's agents (such as an Internet service provider, web design company, employee ...etc.), the Registrant will remain as a principal binded by all terms and conditions of this Agreement and Dispute Policy.
If the Registrant permit any third party to use its Domain Name, the Registrant is still the holder of the Domain Name, and shall be responsible for the fulfillment of all obligations of this Agreement.
9． Limitation of Liability
HKETC assumes no responsibility for any losses caused to the Registrant or any third party for the following reasons :
9.1 Any loss on Domain Name Registration
9.2 The use of Domain Name
9.3 Any delay or interruption regard to HKETC login
9.4 Any data cannot be transferred or transmission errors between the Registrant and HKETC
9.5 Any issues beyond the scope of HKETC reasonable control.
9.6 The process of application being accepted
9.7 Any modification of Domain Name record
9.8 Any payment lapses according to this agreement of the Registrant or his agents
9.9 The application against Dispute Policy
Besides, even if HKETC has received warnings may arise from such losses, no matter due to contract, tort (including negligence) or for other reasons, HKETC not assume any responsibility for the result, no matter indirect, special, occasional, or consequential damages (including loss of profits).
10. LOSS COMPENSATION AND WARRANTY DISCLAIMER
The Registrant hereby agree to, if any third party, make request, litigation or advocate the Registrant's Domain Name or the use of, the Registrant shall protect HKETC and any other related Domain Name registration organizations, and their directors, officers, clerks and agents; you should ensure that the above-mentioned organizations & individuals from any loss, damages, expenses, including reasonable attorneys' fees, arising on the basis of the above behaviors. Registrant must be in full compensation for losses, damages and costs have been generated. The damages do not include any damages required by the dispute policy.
11． DECLARATION AND GUARANTEES
The Registrant represents and warrants that: Cognition and belief the maximum extent, regardless of their Domain Name registration or use, will not, directly or indirectly infringe the legitimate rights of the third party. At the same time, the Registrant represents and warrants that the provision of registration information is complete and accurate. HKETC does not declare nor guarantee that any Domain Name registration under this Agreement will be free from the questioning or the Registrant's registered Domain Name be suspended, cancelled or transferred.
12．BREACH OF CONTRACT AND WITHDRAWAL
If the Registrant violates this Agreement or the Dispute Policy, the Registrant shall receive a notice from HKETC and pay the compensation within 30 days. If the Registrant fail to compensate all losses caused by breach of contract, HKETC will suspend, cancel, transfer or change the Domain Name registration of the Registrant.
When the following situations occur, the Registrant shall follow respective Domain Name Registries' procedures, or any registration institution or registration competent authority procedures which approved by and in accordance with respective Domain Name Registries' adopted policy or pursuant to any other generic top-level Domain Name registration competent authority procedures, to suspend, cancel or transfer the Domain Name:
12.1 other registered institutions or the Registrar who manage the Domain Name correct errors;
12.2 related to Domain Name Dispute Resolution
13． SEVERABILITY
The terms of this Agreement are independent to each other. Any of the terms is identified as invalid, does not affect the validity of other provisions, other terms remain valid.
14． GENERAL AGREEMENT
This Agreement, HKETC Standard Fees, Dispute Policy, Terms & Conditions, the modification(s) and amendment(s), constitute the complete and only agreement between the Registrant and Hong Kong E-Trade Centre, and give priority to replace the effectiveness of any previous proposals, agreements or other consultations. Once the revised agreement(s) or service changes announced in HKETC, or by e-mail or letter notify the Registrant, any modification(s) and amendment(s) immediately bind. The Registrant agrees to visit HKETC regularly , including browse the latest version of all Agreements, in order to keep abreast the modification(s) and amendment(s) of this Agreement. Any of the contents of this Agreement shall not be construed to create any agency, partnership or other form of joint venture for both parties. Hong Kong E-Trade Centre at the time did not require the Registrant to fulfill any of the provisions of this Agreement does not affect any time thereafter require the Registrant to fulfill the right of integrity of this Agreement; at the same time does not mean Hong Kong E-Trade Centre give up the right of recourse or give up the right of recourse against any of the provisions of this Agreement, against the Registrant's behavior of violation of any provision of this Agreement. In any case, by applicable law or court referee determines that any provision of this Agreement is invalid, does not constitute this Agreement as a whole is invalid. In order to achieve the embodied initial text of Hong Kong E-Trade Centre's original purpose and intent, Hong Kong E-Trade Centre will modify or replace with effective provisions. Unless obtained a written consent issued by Hong Kong E-Trade Centre, the Registrant shall not modify or amends any provision of this Agreement, including the Fee Charges and Dispute Policy of HKETC.
